However, due to the broad legal definition of sex work, these actions can still be deemed illegal. For example,a user named Jimmy shared his experience: He was single and decided to visit an erotic massage parlor for a sexual service. After leaving, he was stopped by the police and taken to the station. He was very nervous, fearing jail time. The police reassured him, saying, “Just admit it, it’s only an administrative violation, just a fine, no criminal record.” Later, Jimmy completed the paperwork and cooperated with the prosecutor’s office, where he was informed it was a matter under the Social Order Maintenance Act, requiring only a fine to close the case.

In fact, according to Article 80 of the Social Order Maintenance Act, engaging in handjobs or sexual transactions falls under administrative penalties, with fines up to 30,000, but first–time offenders usually only pay 1,500 至 3,000 and won’t face detention or imprisonment. However, it’s worth noting that if the massage parlor denies offering sexual services and the case is further investigated by a prosecutor, the customer might be summoned as a “witness,” but it still won’t escalate to a criminal case or result in jail time. Some massage parlors advertise openly, with plenty of reviews on forums and groups, easily found and seen by everyone. So why does it seem like the police aren’t cracking down?

states that anyone who intends to profit by enticing, harboring, or mediating others for sexual or indecent acts can be sentenced to up to five years in prison and may also be fined up to NT$ 100,000. The same applies to those who commit the act through deceit.

Some business owners worry that if the police find employees providing handjobs or sexual services during a raid, will the person in charge definitely be sentenced? Actually, it’s not necessarily a criminal liability; the key is whether it can be proven that the business had the intent to harbor, mediate, or profit from such activities.

Take a wellness center in Changhua as an example. When the police raided the place, they found a female masseuse providing a handjob to a male client in a private room and confiscated a used condom on the spot. However, the two people in charge denied any knowledge of this, emphasizing that the establishment explicitly prohibits any sexual transactions and that any employee engaging in such activities privately would be immediately dismissed. The woman also admitted that the NT$ 300s was a private agreement with the client, completely independent of the business’s revenue, and was a ‘personal act.’

Ultimately, the court ruled that although the police found evidence of actual sexual transactions, they could not prove that the business was aware of and allowed lewd acts for profit. Therefore, under Article 231 of the Criminal Code, the two people in charge were acquitted. This case reminds business owners that if they can prove that there is a clear prohibition of sexual transactions within the establishment, that commissions are unrelated to such activities, and that the sexual transaction was indeed a private act by the employee, they might not bear criminal responsibility.

Many wellness center operators might mistakenly believe that as long as they don’t explicitly allow sexual transactions, they won’t face legal consequences. However, if evidence clearly shows that someone in the establishment is offering handjob services, the person in charge could still be convicted for ‘profiting from lewd conduct.’

Take a wellness center in Yilan as an example. After receiving a tip–off, the police sent an undercover officer posing as a male customer. The massage therapist directly asked the officer, ‘Do you want an oil treatment for your prostate? It’s a handjob,’ and quoted a price of NT$ 2000. The police immediately revealed their identity, and during a search of the premises, they seized several used condoms and other customer testimonies, proving that sexual transactions were indeed taking place.

The person in charge, surnamed Liu, argued that he was unaware of the activities, and the staff denied providing sexual services. However, the police had recorded employee conversations and gathered complete physical evidence. The court ultimately found Liu guilty of violating Article 231 of the Criminal Code, constituting profiting from lewd conduct, and sentenced him to three months in prison, convertible to a fine of NT$ 90,000. The case is still open to appeal.

This case serves as a reminder to operators that whether the handjob service fee agreed upon between the staff and the customer is pocketed by the staff or split with the establishment, it doesn’t absolve the person in charge. As long as there is evidence proving the establishment condoned or even profited from it, they could be convicted of ‘harboring lewd conduct,’ and should not take this lightly.
