Ultimately, the court ruled that although the police found evidence of actual sexual transactions, they could not prove that the business was aware of and allowed lewd acts for profit. Therefore, under Article 231 of the Criminal Code, the two people in charge were acquitted. This case reminds business owners that if they can prove that there is a clear prohibition of sexual transactions within the establishment, that commissions are unrelated to such activities, and that the sexual transaction was indeed a private act by the employee, they might not bear criminal responsibility.

The case is still open to appeal.

This case serves as a reminder to operators that whether the handjob service fee agreed upon between the staff and the customer is pocketed by the staff or split with the establishment, it doesn’t absolve the person in charge.
